... because readers apparently misunderstood or simply misread my blog from a couple of weeks ago. And I apologize for garbling, or otherwise irresponsibly delivering my message. I do not support the Patient Protection and Affordable Care Act - now the law of the land.
I think it's a deeply flawed piece of legislation that grants far too much power to not only the federal government, but the secretary of Health and Human Services, who's now been transformed into some sort of health czar.
In fact, this law is so hopelessly muddled that even some of the lawmakers who passed it - and the president who signed it - admit it needs to be fixed.
The argument I put forth a couple weeks back attacked a judge who's opinion, which I believe from my own admittedly layman perspective, is flawed. Have I read Judge Vinson's entire opinion? No, but my biggest issue with the good judge is his logic and subsequent ruling surrounding the severability of the legislation. Case law and common sense suggest judges lean toward severability rather than against, and, again, there's a great deal of precedent for this.
Additionally, I take issue with the time and money squandered on all these appeals when it makes more sense to either fast-track this thing to the Supreme Court (where it's bound to end up anyway) or simply defund the thing in Congress.
And, trust me, I'm well aware how recklessly Pelosi, Reid and friends rammed this thing through (to the extent that not even the sponsors knew everything that was in it). It's hard to dispute it was an irresponsible, overly political, bit of lawmaking that deserves serious re-examination.
Finally, make no mistake, you are the most important part of this entire equation. You're why I write these sometimes-misguided thought pieces of mine. You're why I keep my mouth shut and take my verbal beatings when I get it wrong or we disagree. But never for a second doubt my loyalty or passion for what you do. Without you - or our industry - there's no me.
So I'll leave you this week with Abraham Lincoln, who echoes beautifully my own sentiment: "I am a firm believer in the people. If given the truth, they can be depended upon to meet any national crisis. The great point is to bring them the real facts."
