A few judges on the 4th U.S. Circuit Court of Appeals heard arguments Tuesday over a pair of Virginia lawsuits challenging the constitutionality of the Patient Protection and Affordable Care Act.
But there are a couple of things preventing this from leading today's news. One, that it'll be at least three weeks before this panel hands down what is almost certainly a foregone conclusion. I mean, President Obama appointed two of them, with Clinton having seated the other, so this is hardly a season-ending cliffhanger.

So, you'll have to forgive me for being far more interested in what former Gov. (still-not-running) Mitt Romney has to say Thursday when he takes the podium at the University of Michigan Cardiovascular Center in Ann Arbor for what his aides promise will be his first post-Obamacare, pre-candidate, health care speech.
Will he defy logic and defend the legislation in the face of skyrocketing costs and early signs of care rationing? Or will he 'fess to the colossal blunder, take his medicine and move forward? Or will he lament the legislation yet defend his state's right to determine its own destiny?
I know what would be best for his chances at a White House Run and what both the left and the right want to hear, but I'm honestly hoping he owns this so he's able to turn it around and use what appears to be fatal flaw into a silver bullet.
Stay tuned.
