David Barron, an employment law partner at Cozen O'Connor explains in this short 6-minute video, that if unless an employee is part of a protected employment class (age-related or medical/disability-related) then the company can require them to return to the office once the space has been COVID19 approved for occupancy.
Employees in a protected class category might not be required to return to your office, however. Make sure to check your return-to-work policies to ensure the provisions are specific and enforceable.
