An appeals court affirmed a lower court's ruling that HHS could not force Braidwood and other firms who challenged the ACA mandate to cover PrEP drugs for HIV, however, the nationwide ACA coverage mandate is still in effect.
Last year, the drug industry trade group sued the government, claiming the program violated the Constitution by giving too much power to federal regulators and imposing excessive fines on companies that refuse to negotiate.
"I think there's going to be a huge number of reverse discrimination type cases filed this year and in subsequent years," said employment lawyer Jason Schwartz.
"Make no mistake: Vaccine mandates like the one United is attempting to impose here present a crisis of conscience for many people of faith," Judge James Ho wrote in his dissent opposing the mandate.
